Crash Kills Tahlequah Man, 54

Troopers Say Victim Was Speeding, May Have Been Drinking

POSTED: 3:40 pm CDT September 7, 2008
UPDATED: 4:00 pm CDT September 7, 2008

A 54-year-old man is dead following an alcohol-related, single-vehicle crash in Cherokee County.

The Oklahoma Highway Patrol identified the victim as James Brent Berry of Tahlequah. Troopers said Berry died at the scene from injures sustained in the crash.

The crash occurred at 3:16 a.m. Sunday on a county road southeast of Tahlequah.

The patrol said Barry's vehicle was southbound when it failed to negotiate a curve and struck an embankment, overturned and came to rest on its top. The driver was ejected about 3 feet from the point of rest.

According to a preliminary accident report, troopers detected the odor of alcoholic beverages on the driver and blamed the crash on unsafe speed.

Troopers also said Barry was not wearing a seat belt.
